OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE WEBSITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00). 14. Governing Law and Venue

These Terms and any dispute arising out of or relating to them or the Website shall be governed exclusively by the laws of the State of New Jersey, without regard to its conflict-of-laws principles. Subject to the arbitration provision below, you agree that the exclusive venue for any permitted court action shall be the state or federal courts located in New Jersey, and you consent to the personal jurisdiction of those courts.

15. Dispute Resolution and Arbitration

To the fullest extent permitted by law, any dispute, claim, or controversy arising out of or relating to these Terms or the Website that cannot be resolved informally shall be resolved by binding arbitration administered in New Jersey under applicable arbitration rules, rather than in court, except that either party may bring an individual claim in small-claims court or seek injunctive relief to protect intellectual property or confidential information. You and Four Point Realty agree that each may bring claims only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. If any portion of this arbitration provision is found unenforceable, the remainder shall continue to apply, and you may have the right to opt out as required by applicable law.

16. Force Majeure

Four Point Realty shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, governmental action, power or telecommunications failures, cyberattacks, or Internet service disruptions.

17. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary or severed, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Four Point Realty regarding the Website and supersede all prior or contemporaneous understandings.

19. Modifications

We may modify these Terms at any time by posting the revised version with an updated “Last Updated” date. Your continued use of the Website after changes become effective constitutes acceptance of the revised Terms.

20. Waiver and Assignment

Our failure to enforce any provision shall not constitute a waiver of that provision. You may not assign these Terms without our prior written consent; we may assign them freely in connection with a merger, acquisition, or sale of assets.
